This thesis contains a critical discussion of two metaethical theories: expressivism, as developed in the works of Simon Blackburn, and Cornell realism, as presented by Richard Boyd and David Brink. In the introduction, a distinction is made between external and internal accommodation projects for moral discourse and it is argued that the external accommodation project should be guided by acceptance of methodological naturalism. Expressivism and Cornell realism are then subjected to an extended comparative evaluation, and an answer is sought to (...) the question of which of the two should be favoured. The main conclusion of the thesis is that Cornell realism is rationally preferable to expressivism. This conclusion is arrived at by looking at how well the two theories, respectively, explain various deeply embedded features of moral discourse. Explaining such features is what the internal accommodation project for moral discourse consists in. The assertoric surface-form of moral discourse and the supervenience of moral predicates on natural predicates receive special attention in the study. It is argued that expressivism and Cornell realism do equally well on the issue of moral supervenience. But whereas expressivism is still vulnerable to a particular argument from the philosophy of language, Cornell realism can fend off the criticism that most persistently has been directed at it from this area of philosophy. In a comparative evaluation involving the selected issues, Cornell realism therefore fares better than expressivism. (shrink)

This article is about exit polls. It addresses the question of whether or not it is morally permissible to publish exit poll results. The conclusion of the article is that an affirmative answer should be given to this question. In section 2, the master argument in favor of the moral permissibility of the publication of exit poll results is introduced. This is a strong argument. It is, however, argued that it might be the case that the conclusion of this argument (...) should be rejected if there are other, and weightier, arguments against the idea that the publication of exit poll results is morally permissible. In section 3, the strongest arguments against the moral permissibility of the publication of exit poll results are outlined and discussed. The conclusion of this section is that all these arguments fail in their intended purpose. The conclusion of the article is therefore justified. (shrink)

This paper addresses an important question in normative political theory—Main Question: In a representative democracy, can a member of a legislature legitimately flip-flop and vote in accordance with the majority view on Issue when she—prior to getting knowledge, through a referendum result, of what the majority view is on Issue—has defended and recommended to voters a view that is logically inconsistent with the majority view? This paper defends an affirmative answer to the Main Question. The last section raises the question (...) of whether the trustee view of what obligations a legislator has in a representative democracy toward her constituents is mistaken. An alternative to the trustee view is presented and discussed, and it is concluded that this alternative view is implausible. (shrink)

In this paper, we argue that because of the advent of Artificial Intelligence, the secret ballot is now much less effective at protecting voters from voting related instances of social ostracism and social punishment. If one has access to vast amounts of data about specific electors, then it is possible, at least with respect to a significant subset of electors, to infer with high levels of accuracy how they voted in a past election. Since the accuracy levels of Artificial Intelligence (...) are so high, the practical consequences of someone inferring one’s vote are identical to the practical consequences of having one’s vote revealed directly under an open voting regime. Therefore, if one thinks that the secret ballot is at least partly justified because it protects electors against voting related social ostracism and social punishment, one should be morally troubled by how Artificial Intelligence today can be used to infer individual electors’ past voting behaviour. Antibiotic resistance is a serious public health problem on a global scale. In both developed and developing countries, the unpleasant consequences of the phenomenon are being felt. This paper discusses wild-card patent extensions as a means to incentivize research and development of new antibiotics. The thesis defended in the paper is that the implementation of such patent extensions is an appropriate legislative response to the problem of antibiotic resistance. Much of today’s international trade is conducted according to trade agreements that involve substantial and uniform protections of intellectual property rights. Intellectual property rights are a socio‐economic tool that create a temporary monopoly for inventor firms and enable such firms to charge prices for their innovations that are many times higher than the marginal cost of production of the innovations. This allows the inventor firms to salvage their research‐costs and secure a profit on their innovations. A large body of contemporary (...) philosophical and interdisciplinary literature suggests that intellectual property rights give rise to a number of ethical problems. This review paper seeks to give an overview of what these problems are. It also offers an outline of proposals as to how these problems might be alleviated, and it briefly explains the two classical defenses of the ethical permissibility of intellectual property rights. The ethical issues surrounding intellectual property rights are most pertinent when it is socially valuable goods that are given intellectual property protection. The discussions in this paper revolve around just one product type in order to bring out the broader ethical issues surrounding intellectual property rights. In line with much contemporary literature on the ethical dimensions of intellectual property rights, the product type in question is life‐saving medicines. (shrink)

One objection that has been consistently raised for theorists who are committed to the idea that we have a positive duty to aid the global poor is the overdemandingness objection. This article is a critical discussion of this objection. First, the objection is laid out in some detail. A number of influential attempts to meet the overdemandingness objection are then discussed, and it is argued that they all fail in their intended purpose. The conclusion of the article is not that (...) the overdemandingness objection cannot be met. Rather, the conclusion is that the overdemandingness objection constitutes a serious challenge to anyone who accepts the objection and goes beyond the standard libertarian doctrine and commits herself to the existence of positive duties to aid the global poor. This article is concerned with Mark Timmons and Terence Horgan's influential twin - earth argument against the semantic views of that school of thought in metaethics that has come to be known as “Cornell realism”. The semantic views of Cornell realism have been developed in greatest detail by Richard Boyd, and it is Boyd's view that is targeted by Timmons and Horgan. In the first part of the article, the twin - earth argument is introduced and two versions of it (...) are disentangled. Thereafter, a defensive strategy is developed against the most powerful version of the argument. The conclusion of the article is that Timmons and Horgan's argument does not succeed in showing that the semantic views associated with Cornell realism are false. (shrink)

Global poverty is a huge problem in today's world. This survey article seeks to be a first guide to those who are interested in, but relatively unfamiliar with, the main issues, positions and arguments in the contemporary philosophical discussion of global poverty. The article attempts to give an overview of four distinct and influential normative positions on global poverty. Moreover, it seeks to clarify, and put into perspective, some of the key concepts and issues that take center stage in the (...) philosophical discussion of global poverty. The four positions to be discussed are labeled the Maximalist Position, the Minimalist Position, Intermediate Position I and Intermediate Position II. After an account of these four distinct positions, we turn, in the conclusion, to a discussion of what role empirical sciences such as economics and political science should play in normative considerations about global poverty. Thomas Pogge has recently argued that the way in which research and development of essential medicines is incentivized, under existing World Trade Organization rules, should be supplemented with an additional incentivizing mechanism. One might hold a stronger view than the one that Pogge currently holds, namely that patent rights for essential medicines are morally unjustified per se. Throughout this paper, ‘the strong view’ refers to this view. The strong view is one that enjoys considerable support both within and outside the (...) academic community. This paper critically discusses one specific argument in favor of the strong view. This argument is named the ‘Poggean argument’. This denominator is appropriate because a number of the essential premises of the argument are constituted by propositions that Pogge at some point has defended. The Poggean argument is valid, and defenders of the strong view also have some grounds for believing that the argument is sound. This belief comes, however, with what is arguably a too high cost, namely that the global institutional order becomes very demanding on taxpaying citizens of high-income countries if it is to be just. One may find acceptance of this cost relatively unproblematic, but this cost is, it is argued, unacceptable to anyone who has views on distributive justice that are sympathetic to the core tenets of libertarianism. In this article, we show how it is possible to lawfully buy an election. The method we describe for buying an election is novel. The key things that make it possible to buy an election are the existence of public voter registration lists where one can see whether a given elector has voted in a particular election, and the existence of Big Data Analytics that with a high degree of accuracy can predict what a given elector will vote in an (...) upcoming election. Someone interested in buying an election can enter an employment contract with all, or some of, the opponent electors where these electors are paid to do a job that prevents them from voting. By purchasing access to the public voter registration lists, it is possible to verify ex-post whether the opponent electors that one has signed a contract with have abstained. In the last two sections of the article, we discuss several barriers that can undermine an attempt to buy an election in the manner we identify. (shrink)

Infectious and parasitic diseases cause enormous health problems in the developing world whereas they leave the developed one relatively unscathed. Research and development (R&D) of drugs for diseases that mainly affect people in developing countries is limited. The problem that relatively few drugs are available for diseases that cause an enormous burden of disease in the developing world is called the 'availability problem'. In recent years, the availability problem has received quite a bit of attention. A number of proposals have (...) been fielded as to how this problem might be minimized. Wild-card patent extensions, advance market commitments, cash prizes and the Health Impact Fund are prominent examples of such proposals. These proposals can be thought of as pull-mechanisms for R&D of drugs for neglected diseases. What has been coined a 'priority review voucher' is another pull-mechanism. This paper is a critical discussion of this pull-mechanism. First, the original priority review voucher scheme, as proposed by Ridley et al. (2006), is described. A number of objections to this scheme are thereafter presented. A few amendments to the original scheme are then suggested, and it is argued that with these amendments in place, the priority review voucher scheme constitutes an attractive way of stimulating R&D of drugs for neglected diseases. In 2004, Garrett Cullity made a significant contribution to the literature on what the world’s relatively affluent owe to the world’s relatively poor through the publishing of The Moral Demands of Affluence. In this discussion note, I draw attention to a logical problem in Cullity’s master argument in favor of the view that affluent individuals are justified in spending monetary resources on themselves at a level that lies well above what Peter Singer finds justified. The proposition I defend is that (...) the premises leading to Cullity’s conclusion about the moderate, and not extremely demanding, nature of his position are inconsistent. Thomas Pogge’s "World Poverty and Human Rights: Cosmopolitan responsibilities and Reforms" is a seminal contribution to the debate on global justice. In this review paper, I undertake a kind of stock-taking exercise in which the main components of Pogge’s position on global justuce and world poverty are outlined. I then critically discuss some important criticisms of Pogge's position.

Simon Blackburn’s supervenience argument against moral realism has been widely discussed since its first appearance more than thirty years ago. A number of different suggestions have been made as to how the argument can be countered. In a review of Blackburn’s Spreading the Word, Crispin Wright comments on the argument and rather briefly points out some technical difficulties with it that arise from the formula used in the definition of supervenience. In this paper, I try to show, building on Wright’s (...) criticism and taking a number of new objections into consideration, that the Moorean realist can meet Blackburn’s explanatory charge. This paper is concerned with the expressivist account of moral supervenience that Simon Blackburn has offered. First, the account is presented, and an objection to it is thereafter discussed. In short, the objection is that the supervenience constraint in moral discourse is mysterious, given that no similar constraint governs speech and thought in other areas of discourse that seem to be prime candidates for an expressivist analysis. The conclusion of the paper is that this objection can be fended off.

Jeff Wisdom has recently defended the proposition that any view of moral supervenience worth its salt must incorporate a diachronic view of base property exemplification. Let us call the proposition defended by Wisdom p. In this paper, I try to show that Wisdom has offered no good reasons for accepting p. My argumentative strategy proceeds along two separate tracks. First, I try to show that the thought experiment Wisdom employs in order to underwrite p does not offer the intended support (...) for the proposition. Secondly, I try to show that even if the problems with the thought experiment in question are ignored, there is at least one other reason for thinking that Wisdom has not offered a convincing argument in favor of p. In a paper from 2001, Michael C. Rea considers the question of what pornography is. First, he examines a number of existing definitions of ‘pornography’ and after having rejected them all, he goes on to present his own preferred definition. In this short paper, I suggest a counterexample to Rea’s definition. In particular, I suggest that there is something that, on the one hand, is pornography according to Rea’s definition, but, on the other hand, is not something that we would (...) intuitively describe as being an instance of pornography. In a paper from 2005, Gerhard Overland defends the thesis that one's responsibility to render assistance is not affected by having contributed to the situation by causing harm. Overland applies this thesis to the issue of what duties relatively well-off people have in terms of rendering assistance to the global poor and argues for the sub-conclusion that contribution carries little momentum when assessing our duty to assist people in severe need if we can do so at a little cost. Nicole Hassoun has recently defended the view that the relatively affluent members of the world’s population are, prima facie, obligated to ensure that the global institutional system enables all people to meet their basic needs. This paper is a critical discussion of Hassoun’s argument in favor of this view. Hassoun’s argument is first presented. In sections three and four, I try to bring out a number of formal and informal problems with the argument. Section five discusses a number of possible (...) replies to the worries raised in section four. The conclusion of the paper is that Hassoun’s argument should be rejected. There are two independent and individually sufficient reasons for this conclusion: the argument is invalid and contains at least one false premise. (shrink)

The aim of this paper is to show that David Brink’s influential version of moral realism cannot give a convincing explanation of moral supervenience. Section twocontains an outline and discussion of Brink’s view of moral properties. Section three explicates Brink’s notions of strong and weak supervenience. In sections four and five, Brink’s explanation of moral supervenience is discussed. It is argued that his functionalist view of moral properties means that the explanation of moral supervenience that he explicitly offers is not (...) satisfactory. A suggestion is also made about what the exact nature is of the explanatory challenge that Brink faces inrelation to moral supervenience. Finally, it is argued that Brink cannot meet this challenge. Topical intercultural discourse on historical thinking is deeply determined by fundamental distinctions, mainly between the “East” and the “West.” The epistemological preconditions of this discourse are normally not reflected or even criticized. This article follows Chun-Chieh Huang’s attempt to give Chinese historical thinking a new voice in this intercultural discourse. It agrees with Huang’s strategy of focusing the description of the peculiarity of Chinese historical thinking on fundamental criteria of historical sense-generation. Huang argues for a strict difference between the Chinese (...) way of sense-generation in history and the Western one. Against this distinction I argue that both traditions of historical thinking follow the same logic, namely that of the exemplary mode, which is known in the Western tradition by Cicero’s slogan “Historia vitae magistra.” Instead of claiming this mode as typical of Chinese historical thinking, I propose to clarify the difference between China and the West by looking for a modification of the same logic. Finally the question arises as to what the paradigmatic shift of historical thinking from the exemplary to the genetic mode means for the Chinese tradition Huang has presented. This shift cannot be understood as only a Western one, since it is a mode of pursuing modernity in history by a fundamental temporalization in the interpretation of the human world. (shrink)

This article is divided into five parts. After a brief example in the first part, the second explains what historical sense-generation is about. The third characterizes tradition as a pregiven condition of all historical thinking. With respect to this condition, the constructivist theory of history is criticized as one-sided. The fourth part presents tradition as one of the four basic sense criteria of historical narration. The article concludes with a discussion of the role of tradition in the historical culture (...) of modern societies.Historical sense-generation is a mental procedure by which the past is interpreted for the sake of understanding the present and anticipating the future. This mental procedure is an anthropological universal in the cultural orientation of human practical life and will lead to a concept of the course of time as a necessary factor in the cultural orientation of human life.Today the dominant opinion in metahistory conceives of historical sense-generation in a constructivist way. The sense of the past is understood as an ascription of meaning onto the past; the past itself has no impact on this meaning. But I hold that the past is already present in the circumstances and conditions under which historical thinking is performed and is obviously influenced by it. This presence can be called tradition. Before historians construct the past they themselves are already constructed by the present outcome of past developments in the world. Thus tradition is always at work in historical thinking before the past is thematized as history.Historical sense-generation needs basic principles of sense and meaning. Using these principles transforms the experience of the past into a meaningful history for the present. Despite cultural differences, four sense criteria can be identified as basic for making historical sense of the past. One of the four principles is tradition. It is the most fundamental one upon which all other modes of making sense of the past are grounded. It presents temporal change in the human world such that the world’s order is maintained despite all its changes. Since the emergence of the so-called advanced civilizations, other types of historical narration have overshadowed the constitutive role of tradition. Historical narration has been supplemented by exemplary, genetic, and critical approaches to the past. Yet the traditional one has remained the most frequently used and is the most basic and popular. The historian sits in untimelv contemplation of the creative forces of the human mind in history, recalling the importance of culture in a time of increasing loss of culture. This essay shows the difficulties inherent in the very term of ›culture‹ itself, spe- cifically in political and philosophical contexts between 1910 and 1933. Despite the eagerness and the striking idealism of its founders, Logos never offered an under- standing of culture that was able to resist the totalitarian tendencies of its own time. The term ›culture‹ thus continues to contaminate every attempt to formulate the legacy of the Logos project. From today’s perspective, that means recognizing the (...) need to come to terms with the connotations and the implications of such a project as Logos rather than rushing into a naive and simplistic affirmation. Al- though not the first, Klaus Christian Köhnke and Rüdiger Kramme were the most insistent researchers who brought up this painful subject of the modern history of philosophy. (shrink)

Intercultural comparative historiography raises fundamental methodological problems: Is there any ground for comparison beyond the peculiarities and differences of cultures to be compared? One must avoid taking the Western cultural tradition of historical thinking as the basis for the comparison. Therefore one has to conceptualize the theoretical grounds for comparison and explicate elements of historical thinking which operate in every culture. Then cultural differences in historiography can be analyzed as peculiar constellations of these elements. In order to develop this (...) comparative groundwork, one has to start with some fundamental considerations about historical memory as the universal cultural means of orienting human practical life in its temporal dimensions. On this foundation one has to erect a theory of historical consciousness and its constitutive factors, procedures, and functions. In a systematized form the relationship of these elements can be used to identify the varieties of historical thinking in different contexts over time. This approach has as one objective an intercultural exchange of knowledge about history as a medium for identity-forming. It should enable the participants in this exchange to overcome the widespread logic of exclusion in favor of a more inclusive manner of historical self-understanding. (shrink)

The international economy is changing at a rapid rate. The alteration and reduction of both geographical and political borders, coupled with the growing interdependence of socially, politically, economically, and legally diverse countries, have caused multinational corporate entities to revise various policies. These revisions include revisions in marketing strategies, strategic alliances, product and service strategies and, perhaps most importantly as it affects all strategies, a MNC's approach to ethical systems. The truly global company must come to grips with the legal and (...) moral atmosphere in which it operates. The concept of moral rights, those transcending legal or political rights, drives us to review four international codes of conduct and to attempt to develop one international uniform code that might be applicable to any business, in any country or culture. The old humanistic model, aiming at universalism, ecumenism, and the globalization of various Western systems of values and beliefs, is no longer adequate - even if it pleads for an ever-wider inclusion of other cultural perspectives and for intercultural dialogue. In contrast, it would be wise to retain a number of its assumptions and practices - which it incidentally shares with humanistic models outside the Western world. We must now reconsider and remap it in terms of a larger, global reference (...) frame. This study furthers scholarship on the religion-entrepreneurship link by proposing that aspects of a country’s religious profile impact individual entrepreneurial activity differently and that a country’s level of investments in knowledge serves as a contingency factor in this milieu. Our cross-level analyses of data from 9,266 individuals and 27 predominantly Christian countries support the second, but not the first suggestion. The study contributes to a more nuanced understanding of religion’s role for entrepreneurship and bridges the literatures on religion and knowledge-based (...) entrepreneurship. Furthermore, the study provides evidence of the effects of religion above and beyond the effects of national culture. (shrink)

In his 2013 Theoria article, “Unreliable Intuitions: A New Reply to the Moral Twin-Earth Argument,” Jorn Sonderholm attempts to undermine our moral twin earth argument against Richard Boyd's moral semantics by debunking the semantic intuitions that are prompted by reflection on the thought experiment featured in the MTE argument. We divide our reply into three main sections. In section 1, we briefly review Boyd's moral semantics and our MTE argument against this view. In section 2, we set forth what we (...) take to be Sonderholm's master debunking argument, along with his proposed Boydian explanation of the semantic intuitions he seeks to debunk. Then in section 3, we mount our defence of the semantic intuitions under scrutiny, arguing on abductive grounds that, contrary to Sonderholm, the semantic intuitions generated by reflection on MTE scenarios are to be trusted in evaluating the plausibility of Boydian moral semantics. Jorn Sonderholm (2005) has argued that Simon Blackburn's commitment semantics for evaluative discourse is unable to explain the validity of simple inferences involving disjunction. This is true insofar as the basic rules which Blackburn suggests are not strong enough, but it is relatively simple to augment those rules so as to meet Sonderholm's challenge, whilst respecting the spirit of commitment semantics. One way of doing this is to add a reduction rule such that if accepting p commits one to inconsistent (...) commitments, one is committed to accepting ¬p. Thus Sonderholm has not provided any reason to doubt the adequacy of commitment semantics to explain validity in evaluative discourse. (shrink)

Is philosophy endangered by a scientific culture increasingly influenced by demands of utility and efficiency? What are the goals and intentions of philosophy, and what are the reasons that one practices philosophy at all? The main questions of this collection concern the self-understanding of philosophy. Prominent authors consider historical, systematic, and social approaches to this question and discuss possible answers. The purpose is not merely to legitimate philosophical practice but to understand what such practice consists in at all.

Is it really necessary to add something like the Health Impact Fund to the existing global patent system? We can divide this question into two parts. First, is there something seriously wrong with the status quo and, if so, what exactly is it? Second, how do we best go about solving the problem; that is, how does the design of the reform proposal address the flaws in the status quo? Jorn Sonderholm, in his critique of the Health Impact Fund, or (...) HIF, raises both of these issues. These criticisms afford us the opportunity to reaffirm our commitment to ameliorating glaring problems with the current system for incentivizing R&D for essential medicines, and to clarify why we believe the HIF is exactly what the world needs. In “World Poverty and Individual Freedom” , I argue that the global order—because it is coercive—is obligated to do what it can to ensure that its subjects are capable of autonomously agreeing to its rule. This requires helping them meet their basic needs. In “World Poverty and Not Respecting Individual Freedom Enough,” Jorn Sonderholm asserts that this argument is invalid and unsound, in part, because it is too demanding. This article explains why Sonderholm’s critique is mistaken and misses the main (...) point of WPIF’s argument. It also explains why WPIF is important—it can address some of those most resistant to significant obligations of global justice—libertarians, actual consent theorists, and statists. (shrink)

In a recent issue of this journal, Jorn Sonderholm presents two main criticisms of my 2008 case for a diachronic view of base property exemplification in metaethics. This essay contends that neither of Sonderholm’s criticisms hit their mark, and that there are additional reasons to adopt a diachronic view of base property exemplification. Thus, the case for a diachronic view of base property exemplification in metaethics is stronger than previously thought.

Geschichte im Kulturprozeß by Jörn Rüsen History: Narration, Interpretation, Orientation by Jörn Rüsen.

With particular focus on Danish artists Henry Heerup (1907-1993), Carl-Henning Pedersen (1913-2007) and Asger Jorn (1914-1973), this article illustrates how spontaneous-abstract artists in World War II-era Denmark helped to perpetuate an idealized image of the Middle Ages as a homogeneous and unspoiled social order. It is argued that these artists took medieval culture to represent an uninhibited, irrational art, which they believed had somehow remained unsullied and beyond the exploitation of modern society’s political and capitalist powers. It is further (...) demonstrated that these artists’ idealizations tended to project onto the Middle Ages certain ideas about collectivization and the potentials of institutional critique; these commentaries resonated deeply with the volatile war and post-war political climate of their own times as well and had a clear lineage in earlier movements such as Gothic Revival, Arts and Crafts, Art Nouveau and Symbolism. This article thus posits that the medievalism in and of Danish spontaneous-abstract art can no longer be seen as independent of and unrelated to the medievalisms of the eighteenth and nineteenth centuries. In modern times, religion seems to have taken leave of itself to the extent that, conversely, the scientific, rational view of the world has taken on this task. Apparently there is an exclusive relationship between the two, which makes peaceful and equal coexistence more or less impossible. In this volume of the "Philosophy and Psychology in Dialogue" series, Martin Klüners and Jörn Rüsen analyze the role religion plays in human existence and life. While Klüners interprets religion historically as a "pre-scientific" (...) soul science and sees the antagonism of the principle of reality and pleasure as responsible for the opposition of reason and belief, Rüsen locates religion within historical thought. Like history itself, religion appears to be a significant factor in the cultural orientation of human life practice. (shrink)

Como arcabouço teórico-metodológico, nos munimos das reflexões de Michel de Certeau acerca do lugar social, político, econômico e cultural dos pesquisadores da História, sobretudo um de seus elementos primordiais: o “não-dito”, bem como das propostas do teórico alemão Jörn Rüsen no tocante (...) ao método hermenêutico aplicado na produção do conhecimento histórico. In Humanism in Intercultural Perspective, editors Jörn Rüsen and Henner Laass outline their project of renewing the foundations of the notion of “humanism.” They collect a large variety of contributions they hope will be conducive to this aim. Yet the architecture of the project leaves open a long list of conceptual problems, concerning in particular: the integration of cultural diversity into humanism; the relationship between humanism and the political; the way in which normativity is incorporated into humanism; and the question (...) as to the place of historicity in the human condition. An extended discussion of Elisio Macamo's, Dipesh Chakrabarty's, and Friedrich Wilhelm Graf's contributions to the volume serves to further elucidate these problems and to explore ways in which they might possibly be solved.
